1. A presumption is a rule
2. It allows a court to assume a fact is true.
3. Unless there is evidence to prove otherwise.

Example: The legal conclusion that a person who has disappeared and a person with whom none has made contact in the last seven years is presumed to be dead.
On whom burden of proof lies?
Section - 102
The burden of proof in a suit or proceeding would lie on that person who would fail if no evidence at all were given on either side.
